Criminal Charges not thrown out in torture case

According to authorities, Kyle Ramirez escaped from a couple’s home in Tracy, California last December by unlocking an ankle train.  He then found his way half-naked and stumbling, emaciated and bruised into a health club.  Michael Schumacher, Kelly Lau, married, and Caren Ramirez, and Anthony Waiters, were indicted by a grand jury in March on aggravated mayhem, torture, and false imprisonment of the 16 year old boy.  It is unknown whether Caren Ramirez is of any relation to Kyle Ramirez.  To date, a San Joaquin County judge has refused to throw out the criminal charges against the four, although their attorneys argued that prosecutors did not prove the torture charge.
